These General Terms and Conditions of Sale (hereinafter referred to as "GTC") define the terms of online sales of products offered on the site https://coutellerie-ergot.fr (hereinafter referred to as "the site"), published by Coutellerie l'Ergot.

Any order placed on the site implies full and complete acceptance of these GTC by the buyer.

  1. Purpose

    These GTC define the conditions applicable to the sale of products offered on the site https://coutellerie-ergot.fr by Coutellerie l'Ergot. Any order implies full and complete adherence to these conditions.

  2. Products

    The knives sold are handcrafted in France, made to order. Product descriptions (materials, dimensions, finishes, maintenance) are accessible on each product sheet.
    Non-contractual photos: as each piece is handmade, minor differences may appear between the visuals and the final product.

  3. Availability

    As our models are manufactured in limited series, some products may be unavailable or subject to a manufacturing lead time of up to 12 weeks maximum. The customer is informed before ordering.

  4. Orders

    The customer places an order via the online store. The order becomes final after payment confirmation.
    Any customized order (engraving, custom finish) is firm and non-modifiable after validation.
    If the customer wishes to provide clarification or make a specific request regarding an already paid order, they can contact us within 24 hours at the following address: coutellerie.ergot@gmail.com, clearly stating their request, order number, full contact details, and a phone number. They will be contacted as soon as possible by email or phone.
    Beyond this 24-hour period, or if the order is already in production, no modification or cancellation will be possible.

  5. Prices

    Prices are indicated in euros including VAT (VAT not applicable – article 293 B of the CGI), excluding delivery charges.
    The applicable price is the one in effect at the time of order validation.

  6. Payment

    Payments are secured via credit card or PayPal. The order is only processed upon receipt of payment.

  7. Delivery

    Manufacturing times vary according to the production period (5 days to 12 weeks). Delivery is then made within 2 to 5 business days.
    An email with the tracking number is sent upon shipment.
    By validating the order, the customer accepts this delay. In case of exceeding the maximum legal period (90 days), a full refund can be requested.

  8. Right of withdrawal

    In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from the receipt of the product to exercise their right of withdrawal (excluding personalized products: engraving, special finish).
    The product must be returned in perfect condition, unused, in its original packaging. Return costs are the responsibility of the customer.
    In case of dissatisfaction or doubt about a product, an amicable solution can be found to avoid any discontent.
    For this, the customer must contact us by email at coutellerie.ergot@gmail.com within this 14-day period, explaining their situation and attaching their order number.
    We are committed to examining each request carefully and proposing a suitable solution as far as possible.

  9. Customized products

    Customized products (engraving on the blade or handle, special order) are neither exchangeable nor refundable, except for defects found upon receipt.

  10. Warranty

    • Legal warranty of conformity: 2 years from delivery.
    • Commercial warranty: 5 years against manufacturing defects (see certificate of authenticity).
    • Exclusions: normal wear, misuse, dishwasher, shocks, lack of maintenance.
  11. Claims

    Any claim must be sent by email to: coutellerie.ergot@gmail.com with order number and any photos.
    An appropriate solution will be proposed (repair, replacement, refund).

  12. Responsibility

    The responsibility of La Coutellerie L’Ergot cannot be engaged for non-compliant, dangerous, or prohibited use of the product (see legislation on carrying / transporting / using knives).

  13. Personal data

    The collected data is used solely for order processing and communication with the customer.
    They are never resold.

  14. Disputes

    In case of a dispute, an amicable solution will be sought as a priority, the customer can also refer to a consumer mediator free of charge in accordance with articles L612-1 and following of the Consumer Code.
    In the absence of an amicable agreement, any dispute relating to the sale of products or the interpretation of these GTC will be the exclusive competence of the court of the company's registered office, located in Lillers (62190, France).
    The competent court is the Judicial Court of Béthune (62400).

  15. Use of promotional codes

    The promotional codes occasionally offered by La Coutellerie l’Ergot are valid for a limited time, specified at the time of their communication.
    They are not cumulative with each other, not retroactive, and cannot be exchanged for money.
    A minimum purchase amount may be required depending on the offers. Coutellerie l’Ergot reserves the right to cancel any order that does not comply with these conditions.

  17. Force majeure clause

    Coutellerie l’Ergot cannot be held responsible for any failure to fulfill its contractual obligations in the event of a force majeure event, as defined by French case law (e.g., natural disaster, pandemic, war, fire, total transport strike, energy outage, etc.).
    In this case, order processing may be suspended or canceled without compensation, after informing the customer.

  18. Receipt of the package & immediate claim

    Upon receipt, the customer is required to check the condition of the package. In case of visible anomaly (damaged, opened package), they must make reservations with the carrier and inform us within 48 hours.

  19. Clause on spare parts

    Useful mention for legal transparency (Consumer Code, art. L111-4): the spare parts essential for the use of our products are available on request for a period of 2 years from receipt.
